How do you get arrested for resisting arrest?  Don't you have to do something to get yourself arrested before you can resist being arrested?  There has to be more to this story.

You can be *charged* with resisting arrest, but it clearly cannot be the reason for being arrested in the first place.

He shoved an off duty officer,when he was told the Club was closing a second time...

Yeah sounds like he didn't realize the guy telling him to get lost was a plain clothes undercover.  Those cops NEVER identify themselves and they never show a badge, but yet they always pull rank when shit like this goes down.  I punched a cop in the jaw because he was just a rent-a-cop at some hotel who shoved me, then he tried to have me arrested and said "i clearly identified myself as an officer".  The judge laughed at him and I went on my way.

So you knew he was security, and still attacked him? Also you seemed to miss the part of the story where the owner of the club said Peterson was a problem all night and tried to intimidate a bartender to get served after the bar was closed. Whether the guy identified himself as a cop or security is not an excuse to commit a battery against them.

well he just ran up to me, grabbed me by my throat and shoved me....i'm sorry but whoever does that is getting their jaw broken.  turns out he mistook me for other people at the hotel who were causing trouble.  the cop he called to arrest me wouldn't do it....so he tried to press charges and the judge threw them out.

I agree, no excuse to commit battery on anyone.  However, according to my lawyer friend, committing battery on an undercover officer who didn't ID himself is considered a simple assault charge in the state of Florida, not battery on a law enforcement officer.  I'm sure other states treat this differently. 

One thing is for sure.  Assaulting Joe Schmoe carries a much lighter penalty than assaulting Officer Joe Schmoe.
