Looks like Richie is starting to fight back

Miami Dolphins guard Richie Incognito has filed a non-football injury grievance against the club, challenging his status as "indefinitely suspended" for conduct detrimental, according to sources.

Under Article 43 of the collective bargaining agreement, the maximum a player can be suspended by a team for conduct detrimental is four weeks plus an additional game check. In this case, that would amount to $1,276,470.59. The Dolphins have never defined the length of the suspension, which was announced in the late evening on Nov. 3.

Under the labor agreement, all non-injury grievances must be heard by a neutral arbitrator. Incognito has requested an expedited hearing.

Miami may be forced to decide very quickly whose side they are on with Martin vs. Incognito, because they may be phasing lawsuits from both parties.

1.  They aren't facing a lawsuit from Incognito.  His only recourse is appeal the suspension, in which case he will get back pay, nothing more. 

2. They have picked sides.  They could have suspended Martin and forced him to appeal/sue they haven't. 

If you have listened to Ross it is pretty clear he doesn't like Richie.
