We play the Chargers in week 3...

Modified to add:

Chargers linebacker Shawne Merriman was arrested early Sunday morning for allegedly choking and restraining his girlfriend as she tried to leave his Poway home, the Sheriff's Department said.

His girlfriend, Tila Tequila, 27, signed a citizen's arrest warrant, charging Merriman with battery and false imprisonment.

There are just so many jokes.... choking (on) his tequila... can't hold his liquor...

I realize the seriousness of the situation, but come on, it's also incredibly funny.

Additionally, Smith reportedly has been unhappy with Merriman's extracurricular activities......

She was the star of A Shot at Love with Tila Tequila," which ran for two seasons on MTV. The bisexual dating show featured men and women vying for Tequila's affections. She has also modeled for Playboy and other men's magazines.

So she is a bisexual dating whore and nude model and he's upset she banging other people? What an idiot. Couldn't happen to a nicer guy.

He's already served one suspension for PED's.  Do you think Goodel will take that into consderation when deciding how to punish him for violating the league's personal conduct policy?

He ain't getting suspended and the charges will be dropped.  Police say she wasn't hurt and was very intoxicated.  Multiple witnesses say she was very drunk and all he did was try to take way her keys so she wouldn't drive drunk and she overreacted and then called the cops.

Too bad Stallworth doesn't party with Merriman.  Reyes would still be alive.

Does anyone here know how a citizen's arrest warrant works? I hear he was only taken in because she signed one. I mean, as I understand it, you (the police) gotta go to a magistrate and swear out a warrant to get one, unless exigent circumstances exist (like a cop sees an individual commit a crime). So, how does a citizen's arrest warrant function then?

Sounds like it was just a complaint affidavid. She probably had a bruise or two to back it up .

Or not...

Deputies saw no physical injuries on [Tila Tequila]

from: http://us.cnn.com/2009/CRIME/09/07/merriman.arrest/index.html

Other reports have the owner of the night club Merriman and Tila were at, stating that Tila is lying when she says she didn't drink alcohol.

There are a few procedural things that have me confused, though. Media have reported that Merriman was let go after posting a $50k bond (or thereabouts). It's also been reported that no charges have been filed (yet, anyway).

How does that work? If the state doesn't file charges, how can someone be required to post a bond? I don't get that... (Or maybe the media is just reporting out of their asses... wouldn't be the first time)

It is called station house bail.

You can hold a guy with out filing charges for a finite period of time (typically 48 hours) afterwhich you must arriagn him in front of a judge, charge him with a crime and at that time the judge will hold a bail hearing.  While the judge is not required to offer bail, the judge must hold a bail hearing and it is a very formal process.

For minor crimes the police (no judge involved) will sometimes offer the defendant the option to post bail or release him on PR until the arraignment.

$50K is an outragious sum given the nature of the crime and the almost non-existent risk of flight.  IMHO he should have been released PR.
