Here is angle that nobody seems to be discussing at all......

It was a WOMEN'S bathroom.

In at least some NFL stadiums entering the wrong bathroom (b/c the line in the gender correct one is too long) will get you thrown out of the stadium and cause you to forfeit your season tickets.  This has happened at newer stadiums where building code mandated equal or more women's bathrooms than mens despite the crowd being overwhelmingly male.

If going in the wrong bathroom is reason for a fan to lose season tickets with no refund, shouldn't a player doing the same thing result in some sort of suspension.

I did not know that.  The articles I read just said "bathroom" so I assumed it was one of those unisex bathrooms that just have a single toilet and sink.

I don't see him sexually assaulting a female in a public bathroom in a college bar. Unless this was a small bathroom with only one toilet, those places might as well have a revolving door making it virtually impossible to have forceable sex. That is just my opinion.

It was a single occupancy women's room. 

(Personally I have never seen the point in those and figure it would be better to have two unisex bathrooms than one labeled for each gender if they the designed to be used one person at a time, but the norm in this country is have them segregated by gender.  I think the model used for airline toilets or porta potties [multiple unisex single use facilities] makes more sense when each bathroom is designed for only one person, but that is irrelevant.  The point is it was a women's room.  He should not have been in there in the first place.)

After working college bars for years as security, I can tell you that this happens regularly with people engaging in consentual sex, and more than a few females have been attacked over the years.
Also Ben is a huge star in the NFL and it is ultimately going to come down to a he said/she said debate in the courtroom, and the DA's may not have felt they may not get a conviction based on his status and did not want to waste the resources for a case that would have an iffy outcome at best.

Personally I have no doubt Ben is probably guilty as this type of thing keeps dogging him, and he keeps putting himslef into bad situations with poor choices. Where there is smoke, there usually is fire.

I think this falls into the OJ Simpson gray area......

More than enough evidence to conclude "he more probably than not" committed sexual assault, but not enough evidence to conclude, "beyond a reasonble doubt."

uhmmm.....

Why the uhmmm? Not every guilty person gets sent to trial, and his behavior and judgement has been questionable in the past. He has laid down a pattern of conduct that makes it very plausible he may have done this.
