The details are ugly. Apparently, he was on the side of the road with his engine smoking. The cops came by to check it out and said he smelled of alcohol. To make matters worse, he took a swig from a bottle of alcohol in front of them.

Miguel has battled some drinking problems the past few years, even though he is a very young man. Notably, he blamed his down 2009 and late season collapse on drinking and became clean and sober and had a monster 2010 campaign. I don't know what this means for his 2011, but I hope he gets better. Don't want another Darryl Strawberry.

I hope he gets his act together, but man...how funny would it be to watch him pull out the bottle and take a good belt off it in front of the cops.

As a non-lawyer, I would use his swigging the alcohol in front of them in my defense. It would go something like this, "Your honor, my client was not intoxicated while driving. His vehicle was obviously immobile as the engine was smoking. My client in his time of frustration then opened the bottle and began drinking." I doubt it would work, but I'd go down fighting.

I don't know, I think they can still arrest you if they suspect you were driving while intoxicated or that you may drive.  The car was smoking, was the car running?  Keys in the ignition?  I still think they might have resonable cause to believe you were driving the car or that you were about to drive.  I seem to remember a story where the police found a guy asleep behind the wheel of his car and tested his blood alcohol content and gave him a DUI.  Technically he wasn't driving, just sleeping.  The car was off the side of the road I believe.  Seems like it would be very close to the same thing.

That is my understanding as well.  Intent do drive is all that is required in most states.  Folks have gone to jail for sleeping in their car while drunk. 

Tip to anyone considering sleeping off drunkness in their car instead driving home:  Sleep in the backseat or passengers side.  Seems to be that if you are passed out on over the wheel you have good chance of being convicted.  If you are in the backseat or passengers seat sleeping that usually negates the intent to drive.

I'm sorry but I had to literally laugh out loud when I heard that he basically said "blow me" to the cop and then TOOK A SWIG OF WHISKEY RIGHT IN FRONT OF HIM.

Straight out of something like "Major League."  This shit usually HAS to be in movies because no one, in real life, has the stones to actually pull something like that.
