The Artest situation is a lot different.  There was never any danger to him....he was insulted and humiliated, but going into the stands escalated the situation....also, Artest threw punches and was involved in physical contact.

Davis went to protect his wife.  I think that nobody should go in the stands, but I also think that it's ok for a guy to protect his wife.  Since there was no altercation, I think that the NBA should take action, but to have a 5 game suspension for something like this isn't just.

Sueing because his wife started the altercation and he claims she laid her hands on his face.

If his story is actually what happened he should sue. His name has been printed in every paper, every website, etc. He is automatically considered guilty right now while Davis and family are "heroes". I guess none of us know what really happened.
Then he should sue the media for printing his name, not the Davis's.   The Davis's have done nothing wrong even if she started it.  Still gives him no right to sue.

It was a altercation where no one was injured.   All he is doing is trying to pocket some coin.

DAVE I agree 100%. Too many people are defending the fans on this - but the players are people too. I never blamed Artest for rushing the stands & looking for the fool to punish him for his stupidity. He deserved it. If you don't want trouble don't go looking for any simple as that. What gives fans the right to throw objects at players? Nothing that's what.

One huge difference is Artest had no idea who threw the drink on him & went after just anyone, because the guy he first attacked did nothing. Then he starts throwing punches at them & had the wrong guy.

He was TOTALLY in the wrong.

He has offered to drop the suit for an apology and the Davis' refuse. That doesn't sound like someone only after money to me.

What is there for Davis to apologize for?

Would you apologize to someone when you did nothing to apologize for?

Frankly anyone that brings a suit for money over something like this is just out for money.  No matter what they say.

If he felt the need to defend himself, then all he needed to do is say "Regardless of what has been said about that night, the one thing I want to make clear was I was not drunk.   There was a disagreement & no one was harmed.  To me this matter is closed."

Then move on with your life.  However, he is looking for money.  They always do.

Whatever he wants out of this, he has said an apology will cause the suit to be dropped. Take that for what you want to believe, but it is pretty tough  (actually impossible) to get money from a lawsuit you dropped.

You say the Davis' have nothing to apologize for. Don't fall into that trap the media sets. Like I stated earlier, he claims the woman started the incident. None of us on this board knows who started it. If she did start, it the Davis' do indeed owe an apology. She also has a history of being pretty abrasive, much like Kurt Warner's wife when she was running her mouth in the media.

I am just making this guy's case since everyone here convicted the guy of starting the argument without any inside knowledge.

Its nothing but extortion.    All he is doing is trying to force Davis into accepting all the blame or risk losing some coin.

This should have been a non issue.  I'm sure both parties are guilty to some point.  Very rarely is one party completely innocent in these things.

I highly doubt he would be sueing Joe Fan if this happened between him & another fan.  However, since AD has the cash and is a public figure he figures I can force him to take all the blame & if not then try to pocket some cash.  He knows now no one can prove he was actually drunk, unless a fan sitting beside him remembers him having several beers or something at the game.  Of course this also means no one can prove he was not drunk.  Its now becomes a he said/she said thing.

If its not about money then what is it about?

Again taking this to court is only about money.  Funny how 1 million ( or so he say is less ) will make him feel better about it.

He is flea for even bring up court action.

Let's see; the two sides have now issued a joint statement accepting responsibilities (something the Davis family refused to do initially) and the suit is dropped. Looks like you know exactly what you are talking about.

Thanks.  The Davis's blinked, which is what I said was one of the two options he gave them out of threating a lawsuit.

I still think its sad he went running to Daddy about this.  Daddy they said I was drunk.  Lets sue or force them to apologize or risk spending money in court over this.

Which choice would you choose?

I love this line & they are basically telling you what I said.

Michael Axelrod, 22, works for his father and for Deratany, a family friend.

The guy is a flea & is having to ride Daddys coattails & have a family friend employ him
